In this document we summarize general information and principles for processing of personal data by Driverama Germany GmbH, with registered address at Maximilianstraße 13, 80539 München (the “controller”). Information about processing of personal data within primary processing activities (processing of personal data during purchase of a vehicle, processing of cookies, processing in relation to creation of a user account on the website) of Driverama.de is provided in individual documents available on our website.Processing of personal data follows from Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and repealing Directive 95/46/EC (“DSGVO”) When processing personal data, it is of great importance to us to comply with the law and to follow the principles stipulated in DSGVO and to provide transparent information on the processing.

The entrusted person is appointed for the whole group of companies which the controller is part of. The group of companies consists of Driverama Holdings a.s., with registered address at Dopraváků 723/1, 184 00 Prague 8, Czech Republic, including all its subsidiaries, as well as AURES Holdings a.s. with registered address at Dopraváků 723/1, 184 00 Prague 8, Czech Republic, including all its subsidiaries (“AURES holding”)

In general we process personal data for the following purposes:

  • Conclusion of contractual relationships with clients, suppliers, employees, and performance of obligations arising from contractual relationships;
  • Management of relationships with customers and potential customers and other marketing purposes, including direct marketing;
  • Provision of products and services and improving their quality;
  • Tax and accounting purposes and performance of other legal obligations;
  • Administration of users accounts of data subjects;
  • Prevention and exposing of fraudulent behavior, prevention of conflicts with legislature; prevention of money laundering and financing of terrorism;
  • Processing of camera recordings in order to eliminate illegal behavior and to protect people and property.

Our processing of personal data is based on the following legal foundations:

  • Performance of contractual obligations as per article 6 section 1 b) of DSGVO – such as carrying out individual trades and provision of services, management of relationships with customers, suppliers, employees;

  • Performance of legal obligations as per article 6 section 1 c) of DSGVO – such as archiving, tax and accounting purposes, identification of customers and suppliers; keeping salary agenda of employees;

  • Protection of our justified interests as per article 6 section 1 b) of DSGVO – such as sending of marketing communication, customer satisfaction survey and research activities, processing of personal data related to vehicles, for which a contract has not been concluded, taking video recordings in the company’s branches;

  • Consent granted in accordance with article 6 section 1a) of DSGVO – such as processing of cookies, sending of marketing communication, as requested by the data subject, processing of dynamic biometric signature within electronic contracting.

Within our processing of personal data we store the following categories of personal data: identification data, information about the identification card (within the KYC process), contact data, payment data, information about our mutual communication with the data subject, information on concluded contracts, information on insolvency and execution, information on provided representation authorizations, data related to vehicles, dynamic biometric signature.

We obtain personal data in the following ways:

  • Directly from data subjects – when we obtain data within a contracting process, through direct communication, via our questionnaires and requests filled in by the data subjects;

  • From third parties – from representatives of data subjects, from our suppliers, from public registries and other public resources, such as social media and other internet sources.

If the provision of personal data constitutes a contractual or legal obligation (e.g., provision of identification data, ID cards, payment data and data about the vehicle), the refusal to provide these data will result in non-conclusion of a contractual relationship. Provision of other personal data is voluntary and their non-provision does not have negative consequences for the data subject.

We process personal data for the necessary period of time to fulfil the purpose of their processing, that is, for the time necessary to fulfil contractual obligations, protection of justified interest or for the duration of the legal obligation to process data or which consent with data processing has been granted. The specific duration of personal data storage always depends on the following factors:

  • Type of processed data;
  • Purpose of data processing;
  • Legal foundation for processing of personal data – (for marketing communication that we send based on an explicit request from the data subject, the processing is done until the data subject withdraws their consent with further processing).

Personal data may be processed by the controller, alternatively processors of the controller, and may be shared with other third parties such as separate controllers, if the data subject gives their consent or if such obligation of the controller arising from a contract or from legal obligations (e.g., transfer of data to public administration bodies).

Processors who cooperate with the controller are carefully selected on the basis of the guarantees for technical and organization protection of transferred personal data. Processing of personal data may be done only by those processors who have concluded a contract with us on the processing of personal data.

The categories of recipients to whom we may disclose personal data are: contractual partners ensuring changes in the vehicle registry, transporting companies, marketing and research agencies, providers of technical software solutions and cloud services, providers of administrative archiving, HR, legal, accounting, wage and similar services, providers of postal and communication services and electronic communication services and security agencies.

We do not share personal data outside of the EEA.

In general we do not use automatic assessment of personal data or other methods used to profile data subjects. If the data subject provides consent with the use of cookies, then activities on our website are evaluated automatically and these analyses are used to display special offers based on information about the data subjects.

You have the following rights in relation to personal data processing arising from valid legal regulations:

  • Right to access your personal data – you are entitled to know whether and to what end and in which form your personal data is being processed; however, in case of repeated requests, we may charge fee for each additional copy;

  • Right to correction of incorrect personal data – if you discover that your personal data that we process are inaccurate or incorrect, you are entitled to require a correction of such data;

  • Right to withdraw consent – at any time you are entitled to withdraw your consent with processing of personal data by sending your withdrawal to:dschutz@driverama.com ;

  • right of erasure – if you decide you want your personal data erased from the registry, these data will be erased in the following situations: a) Your personal data are not longer required for the purpose for which they have been collected, b) You raise and objection and there is no justified reason for further processing of your data, c) The deletion is based on a legal obligation, d) Processing of the data is illegal;

We reserve the right, as the controller of personal data, to at any time change and update our procedures and to also edit these principles of personal data protection. This is why we recommend reading these principles regularly. We will handle your personal data in accordance with valid legal regulations and in accordance with the notification on protection of personal data, on the basis of which we collect personal data, unless you give us consent to process these data in other ways.
